General Terms and Conditions of Verein Berliner Kaufleute und Industrieller e.V. (VBKI), VBKI Veranstaltungsmanagement GmbH and VBKI gemeinnützige GmbH


1. scope of application

These General Terms and Conditions apply to all contracts in connection with ticket orders from the VBKI companies (hereinafter referred to as VBKI).

Other general terms and conditions shall only apply if this has been expressly agreed in writing in individual cases.


2. conclusion of contract

A legally binding contract is concluded between the VBKI and the ticket purchaser and all claims (fulfillment and secondary claims) are only to be asserted between these two contracting parties. The company kaiko Agentur - Anja Henschel, Goethestraße 72, 10625 Berlin - has been commissioned by the VBKI as a service agency to handle ticket sales for the VBKI Ball der Wirtschaft 2024.

By purchasing the tickets, the purchaser confirms that he/she has previously read and agrees to the VBKI General Terms and Conditions.

Only persons with full legal capacity are entitled to conclude a contract; anyone who places an order also confirms this.

By clicking on the field for acceptance of the GTCs and "Send order", the offer for the corresponding event is accepted with legal effect and a legally effective contract is concluded between VBKI/ kaiko Agentur and the customer.

The customer is thus obliged to pay and accept the subject matter of the contract (the tickets) from the respective VBKI company. The tickets will only be sent to the customer after full payment has been made. Upon receipt of the tickets, ownership of the tickets shall pass from VBKI to the customer. Only presentation of the original tickets entitles the customer to access the event. Personalized tickets are not transferable. If the tickets are personalized, only the person named on the ticket is entitled to enter the event. Replacement tickets will not be issued. Tickets will not be refunded if lost.

The commercial or retail resale of tickets is prohibited.


3. right of withdrawal

All breaches by customers of the special terms and conditions of ticket sales - e.g. breach of the terms and conditions of the document, breach of prohibitions on resale, any attempts to circumvent them by using several or other user profiles - shall entitle the customer to withdraw from the contract and to claim damages. For the exercise of this contractual right of withdrawal on the part of the organizer, the repayment of the amounts paid shall also be deemed to be an implied declaration of withdrawal. Any breach shall entail an obligation to pay compensation.


4. liability

VBKI shall only be liable for its own breaches of duty in cases of gross negligence and intent. This applies to its representatives and vicarious agents.

Your liability for breach of material contractual obligations is limited to the foreseeable damage typical of the contract. Further liability for damages is excluded.

VBKI shall be liable for injury to life, limb or health in accordance with the statutory provisions.

Claims for damages shall lapse after one year, with the exception of claims for damages arising from injury to life, limb or health. The shortening of the limitation period does not apply to consumers in accordance with § 13 BGB.


5 Obligations of the organizer

The VBKI is liable for the content of the information about the event and the ticket conditions.

He guarantees that the event does not violate the private or industrial property rights of third parties and is not illegal or immoral. In particular, right-wing extremist, racist, extremist, pornographic or violent events are considered immoral.

VBKI shall be liable for compliance with all statutory regulations and any official requirements. Public permits and private licenses must be obtained at the exhibitor's own expense. They must be validly obtained prior to the publication of the respective event.

The organizer guarantees that he has full legal capacity and is authorized to market the event and, in the case of a power of attorney, that this is valid. Proof of this must be provided on request.


6 Prices, payment, order confirmation and invoicing

The respective ticket prices are shown gross and include statutory VAT. Shipping and/or service costs may also be incurred. These are shown separately and are part of the contract. Special services will also be charged extra. The sum of the ticket costs and all additional costs is shown as the total price.

The method of payment is specified on the order page depending on the event. Payment is due in full immediately upon conclusion of the contract. By concluding the contract, the customer recognizes the respective specified payment method as binding.

Payment options are bank transfers and the payment option offered via paypal. For the use of paypal, their terms and conditions apply accordingly; these must be read and accepted before payment.

If the payment method offered is bank transfer, the total price of the order including the additional costs must be transferred to the account specified there without deduction. The cards will be dispatched after receipt of payment. The customer must check these immediately for correctness and, if necessary, lodge a complaint without delay. The customer shall be liable for the timeliness of the receipt of the money and the correct address details. If the customer does not receive the tickets in time for the event due to late receipt of payment or incorrect/incomplete address details and is therefore unable to attend the event, the customer shall not be entitled to any repayment or compensation claims in this respect.

The right of set-off and / or the right of retention is excluded, unless it concerns legally established or undisputed claims.
You will receive an e-mail with an order confirmation and an invoice within 24 hours of receipt of your order on working days.


7. right of revocation / withdrawal

Consumers within the meaning of § 13 BGB have a statutory right of withdrawal.

There is no right of withdrawal for the purchase of admission tickets. There is no right of withdrawal for contracts for the purchase of admission tickets for a leisure event § 312g BGB paragraph 2.

Excerpt from § 312g BGB paragraph 2: Unless the parties have agreed otherwise, the right of withdrawal does not apply to the following contracts:

"Section 312g BGB paragraph 2 no. 9: subject to sentence 2, contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, transportation of goods, vehicle rental, delivery of food and beverages and the provision of other services in connection with leisure activities, if the contract provides for a specific date or period for the provision,"

The customer's right of withdrawal is subject to the cancellation conditions of the respective event.


8. copyright

All contents and illustrations of the VBKI are protected by copyright. Any use not authorized by copyright law will result in compensation for damages.


9. photo right

The ticket purchaser or his/her guests hereby agree that the data stated in the registration, the photos, film recordings and interviews made by the ticket purchaser in connection with participation in the registered event may be used by the organizer in radio, television, advertising, books, films, etc. without remuneration claims until further notice. You have the right to have photos on which you are depicted deleted from our website.


10 Applicable law

Business relations of any kind between VBKI and the customer shall be governed by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

The contract language is German.


11 Place of performance and jurisdiction

The place of fulfillment and exclusive national and international place of jurisdiction is Berlin, provided that the customer is not a consumer in accordance with § 13 BGB. This applies to customers who are registered traders, legal entities under public law or special funds under public law and also to cross-border contracts of non-traders.

For consumers within the meaning of § 13 BGB, the place of fulfillment and jurisdiction is their place of residence. In the case of a non-domestic domicile, the place of jurisdiction shall be Berlin. The VBKI shall also have the right to take legal action in courts with international jurisdiction.


12. final provisions

Any contractual deviation, amendment or addition to these provisions must be made in writing to be effective.

VBKI reserves the right to amend or supplement the GTCs at any time. The change will be made clearly recognizable for the users. If users have been informed of the amendment to the GTCs in writing and have not objected to the new GTCs within 14 days, this shall be deemed to constitute consent. The GTCs valid at the time the contract is concluded shall always apply to the contracts.

If individual provisions of these GTC are or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the provision customary in the industry for this case; in the absence of a permissible provision customary in the industry, the corresponding statutory provision shall apply.
